The legal map

Console modding law varies by country, but the shape is consistent: owning and modding your own console is generally legal, while bypassing copy protection and using pirated content generally is not. This lesson maps the lines.

What is usually legal

• Owning and modifying your own console for personal use (with limits)
• Writing, sharing and running homebrew software
• Making backups of games you own, for your own use, in most regions
• Running emulators (the software is legal; ROMs of games you do not own are not)

What is usually illegal

• Bypassing DRM / copy protection (illegal under laws like the DMCA and EU Copyright Directive)
• Downloading or distributing games you do not own
• Selling or installing pirated content for profit
• Sharing backups, even of games you own

Regional differences

The exact rules differ by country. The US DMCA, the EU Copyright Directive, the UK CDPA and others each define their own exceptions - and those exceptions change. Some countries have carve-outs for preservation, interoperability and accessibility. When you are unsure, check your local law or get professional advice.

Warning: "Everyone does it" is not a legal defence, and neither is "it is an old console". Old games are still copyrighted. A technician who installs pirated games for customers is enabling piracy - and can be held liable for it.
